Coach and Energy Practitioner: Carly Evans
- Agreement. To understand and clarify the services and relationship, Client and Coach acknowledge and agree that:
- As a client, I understand and agree that I am fully responsible for my physical, mental and emotional wellbeing during my coaching calls, including my choices and decisions.
- I understand that coaching is a comprehensive process that may involve all areas of my life, including work, finances, health, relationships, education and recreation. I acknowledge that deciding how to handle these issues, incorporate coaching into those areas, and implement my choices is exclusively my responsibility and as such, my coach is not responsible or liable for any loss which may arise out of my subsequent decisions.
- I understand that coaching is not to be used as a substitute for professional advice by legal, medical, financial, business, spiritual or other qualified professionals. I will seek independent professional guidance for legal, medical, financial, business, spiritual or other matters. I understand that all decisions in these areas are exclusively mine and I acknowledge that my decisions and my actions regarding them are my sole responsibility.
- I understand that coaching does not involve the diagnosis or treatment of mental disorders. I understand that coaching is not a substitute for counselling, psychotherapy, psychoanalysis, mental health care or substance abuse treatment and I will not use it in place of any form of diagnosis, treatment or therapy.
- I declare that if I am currently in therapy or otherwise under the care of a mental health professional, that I have consulted with the mental health care provider.
- Failure to arrive at your session within 10 minutes of your scheduled time will forfeit your session.
- If absolutely necessary, you can reschedule your own appointments within the portal; however you must provide 24 hours notice. Failure to provide 24 hours notice will result in a forfeited session.
2 .Confidentiality. Coach acknowledges that she may obtain confidential personal and/or business information from Client and agrees to keep and maintain such information confidential and not to disclose or use such information without Client’s prior written consent. Client understands that Carly is allowed to share wins, client results and other information on her website or social media and will not disclose names or personal information unless consented to in writing.
3.Intellectual Property Ownership
1.The Intellectual Property in the Services or any document or thing related to the services, and any additions or enhancements incorporated into the Services by Carly Evans is owned by Carly Evans.
2.While this agreement is in force, Carly Evans provides a non-exclusive, non-transferrable, royalty free licence to the Client to access, use, customise, communicate and reproduce Carly Evans’ Intellectual Property to the extent necessary for the Client to obtain the benefit of the Services. When this agreement ends or is terminated, the licence specified in this clause is automatically revoked, and the Client no longer has any permission to access, use, customise, communicate or reproduce any of Carly Evans’ Intellectual property.
3.The Client is under no circumstances to recreate, repurpose or reuse any of Carly Evans’ material to teach to their own customers or communities, resell the content for profit or reuse for any other purposes other than what is outlined in this agreement.
4.The Intellectual Property in any of the Client’s pre-existing material owned by the Client prior to the commencement of this agreement and used in the delivery of the Services is owned by the Client.
- The coaching calls are generally recorded.. You agree to having these calls recorded for your own review and reflections.
4.Waiver. Client acknowledges and agrees that in the course of the services Coach may ask Client questions which may be personal, challenging or disturbing. Client has chosen to undergo coaching services with or without the written consent of their current health professional. Client waives and releases any claims arising or resulting from Coach’s questions, actions or services except for Coach’s breach of their obligations mentioned above. This waiver does not apply to conduct or actions outside the scope of the coaching services.
5.Dispute Resolution. Any controversy or claim arising out of, or relating to, this Agreement or the services provided, shall first be submitted to mediation for an attempt at resolution, with such mediation being conducted by a mutually agreeable party. If the dispute is not resolved by mediation of not less than six hours duration, the dispute shall be settled by binding arbitration in Australia, Australia through and in accordance with the rules existing. The arbitrator shall not have any power to alter, amend, modify or change any of the terms of this Agreement nor to grant any remedy which is either prohibited by the terms of this Agreement, or not available in a court of law.
6. Damage Limitation and Liquidated Damage. The parties agree and acknowledge that Coach is not a guarantor nor an insurer and that the fees provided for hereunder would be substantially higher if Coach was to undertake such responsibilities. The Client also agrees it would be extremely difficult and impractical to fix actual damages to Client, if any, which may result from a failure to perform by Coach. It is therefore agreed, that if Coach is found liable for any loss or damage due to a failure to perform or other breach of this agreement (excluding only willful misconduct), Coach’s liability shall be limited to the total of all payments made by Client or a sum equal to the last six months of Client’s payments to Coach, whichever amount is less.
7. Nature of Agreement. This Agreement shall, in all respects, be governed by the laws of Australia applicable to agreements executed and to be performed within Australia. This Agreement constitutes the entire understanding and agreement of the parties and no amendment, change or modification of this Agreement shall be valid, unless in writing and signed by all of the parties hereto.
8) Services
The parties agree to engage in a 6 session contract. This includes:
6 x 60 minutes coaching sessions (on video call in Kajabi or Zoom, or phone call or in person if the client states this as a preference)
6 x energy treatments (on video call or in person)
9) REIKI/ENERGY TREATMENTS
Reiki is a powerful tool for healing and transforming the mind and body, but does not take the place of professional medical care. Carly Evans will never diagnose or advise in any medical capacity. If you are concerned about your health, always consult your physician or qualified healthcare provider.
Energy treatments are generally conducted laying on a massage table if in person, or via video call with you laying or sitting down in your own space. If you have physical ailments or mental health concerns, always consult with your doctor or qualified healthcare provider before starting a new practice. The position you lay in can be adjusted to suit your needs and your comfort.

You will seek independent professional guidance for legal, medical, financial, business, spiritual or other matters. You understand that all decisions in these areas are exclusively yours and you acknowledge that your decisions and your actions regarding them are your sole responsibility.

You declare that if you are currently in therapy or otherwise under the care of a mental health professional, that you have consulted with the mental health care provider.
10) Schedule and Fees
The fee is of this package can be paid as:
- One full payment of $1800, (can also be made via Afterpay in Kajabi portal). Client understands that the first coaching session will not commence until AFTER the first payment has been made.
10) Refunds
Client understands that payments are non refundable.
11) Procedure
The time of the coaching meetings and/or location will be determined by Coach and Client based on a mutually agreed upon time.
12) Cancellation Policy
Coach reserves the right to cancel coaching sessions when invoices are not paid in advance.
Client agrees that it is the Client's responsibility to notify the Coach 24 hours in advance of the scheduled calls/meetings. Failure to do this will result in forfeiting the session and there will not be a make up session. Coach reserves the right to bill Client for a missed meeting. *Coach will attempt in good faith to reschedule the missed meeting.*
Client understands that failure to arrive at coaching sessions within 10 minutes of scheduled start time will result in forfeiture of session.
13) Termination
Client understands that the coach reserves the right to terminate this contract at any time and recover payment of service rendered.
In the event that a client chooses to terminate the contract, all remaining payments must be made in full.
